User Agreement
The EducationGeneration.org website is a project of Global Agents for Change (hereafter referred to as Global AFC) and all Terms of Use as described below refer to agreements with this organization, and all references to Global AFC and its properties or rights refer to the EducationGeneration.org website and project and all intellectual property contained therein. EducationGeneration.org allows its users to find and support Students in the developing world seeking to continue their education.
Global AFC is a non-profit organization and offers this internet service to its users pursuant to Terms of Use as described below.
Conditions of Use
To use EducationGeneration.org, and its affiliated websites and domain names (collectively, the "Website"), and to access its services, you must agree to the terms and conditions of use (the "Terms of Use"). Please read all of the Terms of Use carefully to be sure you agree with them with the understanding you will be asked to indicate this agreement before using the Website. By using this Website, you agree to comply with, and abide by the Terms of Use. If you do not agree to the Terms of Use, then you are not authorized to use the Website, and may not register on the Website or access certain of the Website's services.
This Agreement may be modified by Global AFC at its sole discretion from time to time and such modifications will become part of this Agreement and will be effective once posted by Global AFC on the Website. Your participation in the Program and use of the Website will be subject to any such modifications. You should review the Website and this Agreement from time to time for any modifications.
Communications in Writing - Electronically
When you visit the Website or send e-mails to us, you are communicating with us electronically. By communicating with us in this manner, you are consenting to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on the Website. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Privacy
Please review our Privacy Policy, which also governs your visit to the Website, to understand our practices. Among other things, our Privacy Notice provides that your personal information may be collected by us, but we will not sell, transfer or share your personal information with any third parties, including without limitation, any other charitable organizations found on our Website, without your consent.

Global AFC is a nonprofit organization that operates this Website under the domain name "EducationGeneration.org". All donations made by users of the Website are irrevocable.
All users of the Website who make donations via the Website, or via substitute methods in lieu of the Website, are deemed Donors, and their donations are governed by these Terms of Use, as well as applicable laws, and governmental rules and regulations.
Global AFC manages the Website, which matches you and other persons (each, a "Donor" and, collectively, "Donors") with Students in developing countries (each, a "Student" and, collectively, "Students") in need of financial support to pursue their studies.
Donors may elect to provide donations to Global AFC itself in addition to donations to be forwarded to other charitable nonprofit organizations. Such donations to Global AFC itself help support the EducationGeneration.org website and project, and are used solely for this purpose.
Donors remain liable and responsible for any fees, charges and expenses of their credit card companies and their financial institutions, in connection with the processing of Website donations, other than merchant charges from these credit card companies and financial institutions. Such other fees, charges and expenses, which Donor remains liable and responsible for, may include fees and charges to consumers with respect to their credit or debit cards, and fees and charges in the nature of charge-backs for bank errors, consumer voided or disputed transactions, insufficient or disallowed funds or credit errors.
Support Disbursements
You understand that Global AFC identifies existing organizations based in Canada and/or internationally (each, a "Program Partner" and, collectively, "Program Partners") that work in developing world communities and work to provide education opportunities to Students that, for lack of funding, otherwise may have trouble accessing education or completing further studies. Any donation made by you or any other Donor will be disbursed to Program Partners to pay for the education costs, as defined by the Program Partner, for each Student you have selected as a recipient. Global AFC aggregates funds from multiple Donors via the Website and passes 100% of these funds (minus online transaction costs charged by PayPal or other payment processors, and excluding the interest earned, if any, on such funds while they are held in Global AFC's account, which is contributed to fund Global AFC's expenses in operating EducationGeneration.org) to the Program Partner(s) to provide for education expenses of the Students selected by Donors. Global AFC only acts as a middle-man in this process. Program Partners are solely responsible for screening each Student and posting requests for Funds on the Website, and Global AFC (a) expressly disclaims any responsibility to screen any Student or any Program Partner, and (b) shall have no liability whatsoever and you shall hold Global AFC harmless from, any and all liabilities with respect to, or resulting from such screenings.
Incomplete Student Funding Before Deadline
Donors understand that in any case where a student does not receive the necessary funding before any imposed deadline, Global AFC will deal with the situation in the following manner and order: 1) Ask the Partner if they are able to supplement this student's funding to ensure they can attend school this term (proof of enrollment will be necessary), if not, 2) Amalgamate funding with that Partner's students to try to ensure the maximum number of students are funded, if residual funding remains, 3) Re-allocate residual funds to any other student on the Website, based on urgency of their funding status, and if any residual remains, 4) Apply this funding to the next student added to the Website. Global AFC will only re-allocate funds between students in the circumstances described above, and Donors agree that Global AFC does not guarantee the ability to notify Donors of which specific student their funding has been allocated to in this case.
Intellectual Property
Global AFC owns and retains all proprietary rights in the Program, the Website and all material and information posted thereon (hereafter referred to as "Content"). The Website contains the proprietary information of Global AFC and its licensors. You may not copy, modify, publish, transmit, distribute, perform, display, or sell any such proprietary information, unless that information that is in the public domain or you have been given express written permission.
If you post any messages or other information on the Website, you agree that such messages and information shall be considered Content, and you shall be deemed to have automatically granted, represented and warranted that you have the right, power and authority to grant to Global AFC an irrevocable, perpetual, non-exclusive, fully-paid, worldwide license to: (a) use, copy, perform, display and distribute such information and content; (b) prepare derivative works of, and/or incorporate into other works, such information and content; and (c) grant and authorize sublicenses of the foregoing.
You acknowledge, consent and agree that Global AFC may, at its sole discretion and to the extent permitted by law, access, read, preserve and disclose your account information, usage history and submitted Content in order to: (a) comply with any applicable law, regulation, legal process, or governmental request; (b) respond to claims that any Content violates the rights of third parties, including intellectual property rights; (c) enforce this Agreement and investigate potential violations thereof; (d) detect, prevent, or otherwise address fraud, security, or technical issues; (e) respond to your requests for customer service; or (f) protect the rights, property, or personal safety of Global AFC, its users, or the public.
Third Party Websites
The Website may provide links to other websites that are not maintained by Global AFC. These links are provided only as a convenience to users. Global AFC is not responsible for the content, products, services or policies or activities of those websites. The inclusion of any link to any such website does not imply endorsement by Global AFC of such website and Global AFC makes no representations, warranties or guarantees of any nature or form with respect to those other websites.
Your Account
You must register on the Website and open a user account to be able to make donations, and to use certain other features on the Website. You are responsible for maintaining the confidentiality of your password and other information associated with your account and for all activity under your account, and for restricting access to your computer, your password and your account. Please notify Global AFC immediately if you suspect or have become aware that anyone may have gained unauthorized access to your account. You agree to accept responsibility for all activities that occur under your account or password.
If you are under 18, you may use the Website only with consent and involvement of a parent or guardian. If you are under 13 you may not use the Website for any purpose other than to view its contents and discuss same with your family, friends, parents and guardians.
Global AFC and its affiliates reserve the right to terminate accounts, remove or edit content, cancel donations or associated purchases, or otherwise refuse Website service or access to anyone, at any time, in their sole and unfettered discretion. In creating your account and/or user profile, photos may not include nudity, and photos or usernames may not include offensive or lewd material. Global AFC reserves the right to reject, refuse to post, delete or remove any user-generated content or posting by you (including without limitation Prohibited Content or Prohibited Identification), or to restrict, suspend, or terminate your access to all or any part of the Website at any time, for any or no reason, with or without prior notice, and without liability.
All funds received by Global AFC from your account are as in Canadian Dollars and all receipts given will be for US Dollars.
Disclaimer of Warranties and Limitation of Liability
This Website is provided by Global AFC on an “as is” and “AND "as available” basis. Global AFC makes no representation of warranties of any kind, express or implied, as to the operations of this website or the information, content, materials, or products included on this website. You expressly agree that your use of this website is at your sole risk.
To the extent permissible by applicable law, Global AFC disclaims all warranties, express or implied, including, but not limited to, implied warranties of merchantability and fitness for a particular purpose. Global AFC does not warrant that this site, its servers, or email sent from Global AFC are free from viruses or other harmful components. Global AFC will not be liable for any damages of any kind arising from the use of this site, including but not limited to direct, indirect, punitive, and consequential damages.
Certain regional laws do not allow limitations on implied warranties of the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimer, exclusions, or limitations may not apply to you, and you might have additional rights. Global AFC does not provide you with any representations or warranties with respect to the application of these exclusionary laws to you.
Limitation of Liability
You understand that any and all decisions made by you with respect to the Program are yours alone. Global AFC cannot and does not verify the accuracy of information from Program Partners, other Users or Students. Global AFC shall not be responsible, or have any duty or obligation to, or liability for: (a) decisions or interactions resulting (directly or indirectly) from participation in the Program; or (b) any damages, costs, losses or expenses a User incurs as a result (directly or indirectly) of making a donation to a Student or as a result (directly or indirectly) of utilizing the Program or information received in connection with the Program. In addition, in no event will Global AFC be liable to you or any third person for any damages, costs, losses or expenses, including any lost capital, lost profits or special, incidental, consequential or punitive damages arising from your use of the Website or participation in the Program, even if Global AFC has been advised of the possibility of such damages, costs, losses or expenses.
Disputes with Program Partners, Students
You are solely responsible for your interactions with any Program Partners, any other User (even to the extent prohibited hereby) or any Student and any disputes that may result from such interactions. Global AFC reserves the right, but has no obligation, to monitor disputes between you and such persons.
Term; Termination
This Agreement will remain in full force and effect while you use the Website or participate in the Program as a User and, notwithstanding anything herein to the contrary, this Agreement will remain in effect after your participation in the Program and status as a User is terminated. Whether or not you are and remain eligible to participate in the Program may be determined by Global AFC in its sole and absolute discretion. You may terminate your participation and status as a User at any time and for any reason by sending a written notice of termination to Global AFC, such notice to be effective within 3 days of receipt by Global AFC. Global AFC may also terminate your participation in the Program and status as a User at any time and for any reason, effective upon transmission of notice to you at the email address you provide to Global AFC. If your participation in the Program is terminated by Global AFC, you agree not to use the Website any further.
Entire Agreement; Severability
This Agreement, accepted upon use of the Website and further affirmed by becoming a User, contains the entire agreement between you and Global AFC regarding the use of the Website or the Program. If any provision of this Agreement is held invalid, the remainder of this Agreement shall continue in full force and effect.

Applicable Law
By visiting EducationGeneration.org, you agree that the federal laws of Canada and/or the applicable laws of the Province in which you reside, without regard to principles of conflict of laws, will govern these Conditions of Use and any dispute of any sort that might arise between you and Global AFC or its affiliates.
No Waiver
Global AFC's failure to enforce the Terms of Use, or any portion of such Terms of Use, in every instance in which they might apply is not a waiver of any of Global AFC's rights, and Global AFC reserves its right to take all legal steps available to enforce these Terms of Use. /p>

We value your privacy.
Global AFC will not rent or sell your personal information to third parties.
By default, you will receive update emails on the students you have supported, should our Program Partners provide these updates through the Website. Global AFC will not disclose your email address to our partners for any reason -- these updates are directed through the Website and Program Partners and other third parties will not have access to your information. You can choose not to receive these emails through a preference in your account on the Website.
You will receive an email update if a student you have supported re-enters the system and is seeking further support.
By default, you may receive periodic newsletter emails about Education Generation. The frequency of these newsletters may vary but will be no greater than once per month. You can choose not to receive these newsletters through a preference on the Website.
Global AFC will not disclose donation activity that is identifiable with any one donor to any third party without consent. Global AFC reserves the right to record and display anonymous lending activity on the Website and display the general regions where our Donors are located.
